These Terms of Service (“Terms”) govern your use of https://flightcat.io and Flightcat’s related applications and integrations, including its ChatGPT integration (collectively, the “Service”).
The Service is operated by Flightcat.io, doing business as Flightcat (“Flightcat,” “we,” “us,” or “our”).
1. Acceptance and eligibility
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old and meet any higher minimum age required in your jurisdiction. If you are below the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian.
If you use the Service on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.
2. What Flightcat provides
Flightcat helps users discover and compare flight options, including through natural-language searches and AI-assisted features.
Flightcat does not operate flights, issue tickets, or act as the contracting provider for travel purchased through third-party links. A search result or referral does not create a reservation or guarantee that a fare is available.
3. Prices, availability, and AI-generated information
Flight prices, schedules, availability, and fare conditions can change quickly. Results may be delayed, incomplete, or inaccurate. Displayed prices may exclude baggage charges, seat-selection fees, or other optional charges.
AI-assisted features may misunderstand your request or produce incorrect information. Before purchasing travel, confirm the itinerary, airports, travel dates, passenger details, total price, baggage allowances, and cancellation conditions directly with the booking provider.
Flightcat does not guarantee the lowest price, complete market coverage, or availability of any displayed offer.
4. Third-party bookings and services
If you follow a link to an airline, travel agency, or other provider, your use of that provider’s service is governed by its terms and privacy policy.
The provider is responsible for its booking process, payment collection, ticket issuance, changes, cancellations, refunds, and travel services. Direct questions about an existing booking to that provider.
When you access Flightcat through ChatGPT or another platform, that platform’s terms also apply to your use of the platform. Flightcat is independently operated and is not made or endorsed by OpenAI.
5. Your responsibilities
You are responsible for providing accurate search information and confirming that any travel you purchase meets your needs.
You are also responsible for checking passport, visa, transit, entry, and other travel requirements with the relevant authorities and travel providers.
Do not submit payment-card details, passport numbers, passwords, or other sensitive information through Flightcat’s search fields.
6. Acceptable use
You may use the Service only for lawful purposes. You must not:
- Interfere with the Service’s operation or security.
- Attempt to access systems or information without authorization.
- Bypass access restrictions or rate limits.
- Use automated requests in a way that disrupts or materially burdens the Service.
- Submit unlawful content or information you do not have permission to provide.
- Use the Service to commit fraud or infringe another person’s rights.
7. Your content and privacy
You retain any rights you have in the content you submit. You grant Flightcat a limited, nonexclusive license to process that content as necessary to operate the Service and respond to your requests.
Our Privacy Policy, available at https://flightcat.io/privacy, explains how we collect, use, share, and retain personal information and how you can exercise applicable rights.
These Terms do not provide separate consent for optional advertising, tracking, or AI model training.
8. Intellectual property
Flightcat and its licensors retain their rights in the Service’s software, branding, designs, and other protected materials. These Terms grant you a limited right to use the Service for its intended purpose.
Third-party trademarks, flight information, and other materials remain subject to their owners’ rights. Nothing in these Terms restricts uses permitted by applicable law.
9. Availability and suspension
We may update, modify, or discontinue features of the Service. We may restrict or suspend access where reasonably necessary to address a breach of these Terms, security threats, unlawful activity, or legal requirements.
Where reasonably practicable, we will provide notice of a material discontinuation or suspension and explain how to contact us about it. You may stop using the Service at any time.
10. Disclaimers
To the extent permitted by applicable law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted operation or that information will always be accurate, complete, or current.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
11. Liability
To the extent permitted by applicable law, Flightcat is not liable for indirect or consequential losses arising from use of the Service.
Flightcat is not responsible for a third-party provider’s acts or omissions, including flight disruptions or booking disputes, except to the extent applicable law makes us responsible.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
12. Changes to these Terms
We may update these Terms from time to time. We will publish the revised Terms with an updated effective date and provide reasonable advance notice of material changes where required by law.
Changes will apply prospectively. Where applicable law requires your agreement to a change, we will obtain it before applying that change to you.
13. Governing law and disputes
These Terms are governed by the laws of Travis County, Texas, subject to any mandatory consumer protections that apply where you live.
Disputes will be handled by the courts of Travis County, Texas,, except where applicable law gives you the right to bring a claim elsewhere.
You may contact us to seek an informal resolution before starting proceedings. This does not limit your legal rights or access to courts.
14. General
If a provision of these Terms is unenforceable, the remaining provisions will continue to apply. A delay in enforcing a provision does not waive the right to enforce it later.
